On 1 July, smoking was banned in all enclosed public places and commercial premises in England. Your business has almost certainly be affected to some extent by the new law.
Smoking is not only bad for those who smoke. Research by the Smokefree England campaign suggests that exposure to secondhand smoke can increase the risk of lung cancer and heart disease by around 25 per cent.
Just 30 minutes of passive smoking can reduce coronary blood flow. "The main aim of the smoking ban is to limit the damage to public health in enclosed spaces," asserts Fiona Andrews of Smokefree England.
COMPLYING WITH THE BAN
All business owners are responsible for ensuring their workplace and any work vehicles used by more than one person are smoke-free. This means putting up 'No Smoking' signs in the workplace, in public entrances and in vehicles. The no-smoking signs need to meet the requirements that are set out in the Smoke-free (Signs) Regulations. You will also have to close down indoor smoking areas and remove ashtrays.
"Employers can provide a covered smoking area outside, as long it is not enclosed," advises Andrews. "If you're unsure about what enclosed premises are, go to the Smokefree England website - wwwsmokefreeengland.co.uk. You should also consult your local environmental health team if you intend to create a smoking area so you don't fall foul of planning regulations."
You should have given your staff notice of the ban. "We would advise employers to have a written policy," Andrews continues. "If a compliance officer finds someone infringing the ban, you can point to your policy to demonstrate you've taken adequate steps to communicate the regulations."
